Copyright - What is 'Innocent' Use? |
While
busy surfing, I came across a TE that uses the Wabash Cannonball as
signature music. It's a cute catchy tune that went places in
its heyday and is strongly copyrighted.
That thought got me thinking about copyright abuse vs. keeping some
darned good history alive and encouraging traffic to the sites of the
rightful users because of it.
While I sure do not support breaking copyright law for any reason, and
you should ask the owners for permission to use it, I can see
'innocent' use as a great way to keep history current.
Trouble is - what is 'innocent use' and how do you define that kettle
of fish?

So You Want
to be an Internet Marketer
So you
have decided you want to be an internet marketer. You've seen
the ads on TV for people making 5-10 thousand a month from the comfort
of their homes. Basking by the swimming pool outside of their
palatial estate with a bright sun shining down on their
success. Perhaps you've seen similar ads while surfing or
searching the net.
You send
for information or signup for the program and go to sleep that night
dreaming of the success and money that will soon be yours with all of
the people above you helping you to build your business.
Dreams of dollar bills floating down from the heavens
penetrate your sleep. Ahh what a wonderful life!
You wake
up excited thinking about your dreams. You go to your Just
Over Broke saying to yourself, "I'll soon be telling my boss
where to take his job! I'm going to be rich in this internet
marketing program" "Free riches for all".
You can hardly concentrate on your job for you are thinking of the
riches promised you that your sponsor was going to help you
gain.
You get home and eat and get on the computer and check your email and
PayPal account looking for the money your sponsor made for you while
you were at work. After all you were promised massive
spillover and riches beyond compare.
Nothing, no emails, no PayPal notifications. You email your
sponsor asking why you have made no money. You hear nothing
for a couple of days. Then you get another series of emails
saying you need to get this autoresponder program, your own website, a
splash page maker and information that you are supposed to share with
your family and friends.
So you
spend more money; $20 for an autoresponder, $20 for hosting,
$15 for a splash page maker, and then wonder how you are supposed to
make them all work. You ask your sponsor and he says look at
the instructions. Oh, and if you want training, he
has a series of videos you can download for $297 that will guarantee
you success if you follow them. So you spend the money and
discover that they are complicated and hard to understand.
All this html stuff , meta tags, keywords etc. Again you
contact your sponsor and he says " it simple just follow instructions"
and then hangs up on you. So you try again and start thinking I must
really be a dummie. Meanwhile you've contacted your family
and friends and are met with comments, such as "what a fool you are you
fell for that hype, or how much have you made, or when you start making
money let me know".
You keep
trying and trying and nothing happens, you finally got a website up and
wonder why you're not getting any traffic, sales or signups.
You contact your sponsor again via email and it bounces back to you,
alarmed you try and login to your affiliate site, only to discover that
this domain is not available.
Disgusted
you say to yourself, what a fool I am. I'll not fall for those scams
again.
A few
months later you get an email from your old sponsor who tells you the
company took off with everyone's money but he has a sure fire program
that just started and thousands are being made by those getting in
now. You think to yourself, well I've got to make up my
losses, let me try this again.
And again
and again and again ...

Copyright
The Law vs 'Innocent' Use
According to Wikipedia,
copyright is a form of intellectual property which gives the creator of
an original work exclusive rights for a certain time period in relation
to that work, including its publication, distribution and adaptation;
after which time the work is said to enter the public domain.
Copyright applies to any expressible form of an idea or information
that is substantive and
discrete.
In the USA, Some jurisdictions also recognize "moral rights" of the
creator of a work, such as the right to be credited for the work.
Copyright has been internationally standardized, lasting between fifty
to a hundred years from the author's death, or a finite period for
anonymous or corporate authorship; some jurisdictions have required
formalities to establishing copyright, most recognize
copyright in any completed work, without formal registration.
Generally, copyright is enforced as a civil matter, though some
jurisdictions do apply criminal sanctions.
The above is just an overview of copyright but should give you greater
insight into what the author rights are over what your 'innocent' use
represents.

I hope you
are ready to look in the mirror and investigate where you stand when
you read this article. Well, you probably have no splashes because you
are too lazy, can't find the time, simply don't know how.
Too lazy:
In this case, get off your duff and go to work
researching
and learning how to make YOUR business work because no one else can or
will do it for you no matter what they say like "No recruiting, No
selling, No spending". At least one of these factors is always present
in your road to success and most of the time the bottom line is you
have to do all three. So, admit the reality and go to work. The
alternative is play games on the internet or simply cancel your
internet and give your computer to charity where it may do some good!
Can't
find the time:
In this case you must get a
lesson in time
management or just make the time available as per so many hours a day
or week. Need I say if you still cannot find the time go back and read
the first sub-topic in this article once more.
Don't know
how:
This is no excuse! There are
places on the
internet to get everything you need to know about marketing and network
marketing as well FOR FREE. And you can get tools free as well and if
you have windows on your computer you already have some of
these tools
and do not even know it. Look for "free marketing courses" on the
internet through Google. Look for the author's you see in this ezine on
Google. Or just follow their links and I am sure you will find some
helpful information if you cannot find enough reading this ezine.

THE
BUZZARD, THE BAT, AND THE BUMBLEBEE
THE BUZZARD:
If you put
a buzzard in a pen that is 6 feet by 8
feet and is entirely
open at the top, the bird, in spite of its ability
to fly, will be an
absolute prisoner. The reason is that a buzzard
always begins a flight from the ground with a run of
10 to 12 feet. Without
space to run, as is its habit, it will not even
attempt to fly, but will
remain a prisoner for life in a small jail with no
top.
THE BAT:
The
ordinary bat that flies around at night, a
remarkable nimble
creature
in the air, cannot take off from a level
place. If it is
placed
on the floor or flat ground, all it can do is
shuffle about helplessly and, no doubt,
painfully, until it reaches some
slight elevation from which it can throw itself
into the air. Then, at once, it
takes off like a flash.
THE
BUMBLEBEE:
A
bumblebee, if dropped into an open tumbler, will
be there until it dies, unless it is taken out.
It never sees the
means of escape at the top, but persists in trying
to find some way out
through the sides near the bottom. It will seek a
way where none exists,
until it completely destroys itself.
PEOPLE:
In
many ways, we are like the buzzard, the bat, and
the bumblebee.
We struggle about with all our problems and
frustrations, never realizing that all
we have to do is look up!
Sorrow
looks back, Worry looks around, But faith
looks up!

Choke in a restaurant in the South
Two
hillbillies walk into a bar. While having a shot of whisky, they talk
about their moonshine operation.
